Terms of Service

Effective 2026-06-21 · Plain English, no surprises.

1. Acceptance

By creating an account on Duck Stats or using any of our monitoring services, you agree to these terms. If you don't agree, please don't sign up — there's no hidden click-to-accept, no buried checkbox. If something here is unclear, email [email protected] before you sign up and we'll explain.

2. What Duck Stats does

Duck Stats is an uptime and server-health monitoring service. We probe URLs, TCP ports, databases, and ping targets you configure, and we receive heartbeats from agents you install. We send you alerts when something breaks. We host public status pages on your behalf. That's the whole product.

3. Acceptable use

You can monitor anything you have permission to monitor — your own websites, services on infrastructure you control, third-party services with the operator's consent. You may not:

  • Use Duck Stats to flood, stress-test, or DoS a target you don't own.
  • Probe at intervals faster than your plan allows (we rate-limit, but don't try).
  • Host illegal content, doxing, or harassment material on a status page.
  • Resell raw access to our probe network as your own monitoring product.

If we see abuse, we'll email you first. Repeat or egregious abuse can lead to account suspension.

4. Pricing & billing

We offer three tiers:

  • Free — $0/month. 25 monitors, 5-minute interval, single-location checks, email alerts.
  • Premium — $19/month. 250 monitors, 1-minute interval, 4-location consensus probes, all alert channels, API access.
  • Enterprise — custom. Unlimited monitors, 20-second interval, custom SLA, optional self-hosted deployment. Contact us.

Premium is billed monthly in advance. Prices are in USD. Tax may be added based on your jurisdiction. We'll give you at least 30 days' notice before raising prices on an existing subscription.

5. Cancellation & refunds

You can cancel Premium anytime from your account settings. Cancellation takes effect at the end of your current billing period — you keep Premium features until then, after which the account downgrades to Free (your existing monitors stay; the ones above the Free tier limit get paused, not deleted).

We do not issue automatic refunds for partial months. If you cancel mid-cycle for a reason on our end — sustained outage, billing error, accidental double-charge — email [email protected] and we'll prorate or refund manually. We're a small operation, we'll be reasonable.

6. Service level

The Free tier comes with no service-level commitment. We run it on the same infrastructure as Premium and it almost always works, but if it doesn't, your remedy is to stop using it.

Premium is best-effort: we aim for 99.9% probe-network availability and we publish our own status at stats.duckingstats.com/status/probes. If we miss that materially, contact us about a service credit. Enterprise plans get a written SLA in the contract.

7. Your data is yours

Your monitor configurations, status pages, branding, contact lists, and historical data belong to you. You can export them at any time via the API or by emailing us. If you cancel your account, we keep your data for 30 days in case you come back, then delete it. Full deletion details live in our Privacy Policy.

8. Liability

Duck Stats is provided as-is. Monitoring is by nature probabilistic — probes can be wrong, alerts can be late, the internet can be weird. We do everything we reasonably can to make the service accurate and timely, but we are not liable for consequential damages: lost revenue, missed SLAs with your own customers, downstream outages you discovered late because we missed an alert, or any indirect loss. Our total liability for any claim is capped at the amount you paid us in the 12 months preceding the claim (so, for Free users, that's $0).

9. Modifications

We may update these terms. If we make a material change — anything affecting pricing, data handling, or your rights — we'll email all account holders at least 30 days before it takes effect. Cosmetic or clarifying edits don't require notice but will always bump the effective date at the top of this page.

10. Governing law

Duck Stats is operated from Texas, USA. These terms are governed by Texas law, and any dispute that can't be resolved by emailing us first will be handled in the state or federal courts of Texas. If you're outside the US, this is still where the contract lives.
